The Hendry Home & Exteriors website and our products are provided subject to the following Terms and Conditions. Please ensure you read the terms set out below carefully, as you are engaging in an agreement to be bound by the following Terms and Conditions by continuing to use our Site or by purchasing something from us. These Terms and Conditions apply to all users of the Site, including without limitation users who are customers, browsers, vendors, merchants and contributors of content.

Our Contract With You

These are the terms and conditions on which we supply Goods, or Services, or both Goods and Services, to you.
Please ensure that you read these Terms carefully, and check that the details on the order and in these terms are complete and accurate, before you place your order. If you think that there is a mistake or require any changes, please contact us to discuss. We will confirm any changes in writing to avoid any confusion between you and us.
When you sign and submit the order to us, this does not mean we have accepted your order for Goods and/or Services. Our acceptance of the order will take place as described in the next section. If we are unable to supply you with the Goods and/or Services, we will inform you of this and we will not process the order.
These Terms will become binding on you and us when we issue you with a written acceptance/invoice of an order and a 50% pre-payment is made, at which point a contract will come into existence between you and us.
We shall assign an reference to the order and inform you of it when we confirm the order. Please quote the reference in all subsequent correspondence with us relating to the order.
Prices quoted, invoiced, and agreed, include the cost of goods and fitting.

Made to measure goods

All products sold by Hendry Home and Exteriors are bespoke and made-to-measure to your requirements. As such, they fall into the category of tailor-made products under the Consumer Contracts Regulations 2013 and you will not, therefore, be able to cancel your order for any product(s) once placed, provided that this will not affect your legal rights as a consumer in relation to bespoke and made-to-measure products that are faulty or not as described.
We reserve the right to end the contract if we find at survey there is an unacceptable difference between the amount quoted for the goods and that determined by the technical measure. The foregoing is in substitution for all other terms, expressed or implied relating to the quality or fitness for purpose, and all such terms are hereby excluded. This does not, however, affect the customer’s statutory rights.
All goods must be paid for in full prior to delivery/fitting, we ask for the balance upon booking in once this has been paid in full this ten confirms the installation date of the goods.

Delivery of goods

All goods are sold to the buyer on the following conditions. The seller does not accept any responsibility arising from the buyer’s failure to follow these conditions.
The buyer must check that the awning or pergola are in accordance with the purchase order. The seller cannot accept responsibility in circumstances where the buyer is not present at the delivery/installation address.
The seller cannot guarantee precise colour matching against samples, our products are made from a coated aluminum. Colour matching of finishing products (e.g. paints and stains) cannot be guaranteed although every reasonable effort will be made to ensure the accuracy of the finished product.
Fabrics: With regards to fabrics for the awnings, please note that colour may vary from batch to batch on some styles, and that fabrics are periodically discontinued. On discontinued items, we reserve the right to substitute warrantied product with the nearest colour or style of equivalent. That said, we would make every effort to match the current style and colour if you have multiple awnings sat next to each other. In the event that warrantied product is not repairable, and cannot be replaced with the original style and colour (i.e. discontinued), it will be replaced free of charge with the closest available product.
Under no circumstances except in respect of death or personal injury caused by the seller’s negligence does the seller accept liability for consequential loss, damage, costs or expenses, however arising and any liability for any such consequential loss damage is hereby specifically excluded. Should a claim be made the seller’s liability is limited to the value of the order placed by the buyer.(h) The seller gives no warranty as to the fitness of the product supplied for any purpose other than that of an internal window dressing as surveyed by the company, other installation and uses are the risk of the buyer.

Pricing

All our prices are in GBP (£). We sell according to our suppliers’ recommended retail prices and pay our suppliers and makers fairly.

Our prices are subject to change without prior notice. We reserve the right at any time to modify or discontinue a product without prior notice and we will not be liable to you or to any third-party for any price change, modification or discontinuation of a product.

(With the blinds and awnings we currently only offer bank transfer) 

PRODUCTS

We sell products online in limited availabilities and quantities and our products are subject to return/exchange only according to our Returns Policy. We reserve the right to limit the quantities of any product that we offer. We reserve the right, but are not obligated, to limit the sales of our products to any person or geographic region. All descriptions and pricing of products are subject to change at any time without prior notice. We reserve the right to remove any offers on products or discount codes on the Site at any time without prior notice. We do not warrant that the quality of any products acquired by you will meet your expectations.

We endeavour to display all our products as accurately as we possibly can, however, please take into account that our photos may not be to scale so always ensure to carefully read the measurements on the product description prior to purchasing. While we endeavour to reproduce colours as accurately as we possibly can, we are unable to guarantee that your device screen’s display of colours will be accurate, so please be aware of this prior to purchasing. Several of our products are handmade and, therefore, each individual piece is unique and variations will occur. This is particularly relevant for handmade throws and cushions, so please be aware of this prior to purchasing.

 Please note: that our Blomus and Elvang range is non refundable and we unfortunately cannot accepts returns or refunds on these products.

PAYMENTS

THE FOLLOWING APPLIES TO THE SHOP

Hendry Exteriors accepts payments from all major debit cards, credit cards and payments via Klarna. Prior to the order being despatched, payment will be debited from your account. In the unlikely event that your account has been debited but you have not received a confirmation of purchase email, please contact us via email and we will resolve the issue as quickly as possible. Debit/credit card holders are subject to authorisation by the card issuer. If your card is declined, the order will not be accepted and you will not receive a confirmation of purchase email. In the case of a card refusal/decline, Hendry Exteriors will not be responsible for non-delivery.

ORDERING

THE FOLLOWING APPLIES TO THE SHOP

When an order is placed on our Site, you will receive a confirmation of purchase email to confirm that we have received your order. When we accept the order via the confirmation of purchase email, a legally binding contract is generated between us. Please make sure that you keep a copy of the confirmation of purchase email, as we may require you to refer to it should there be an issue with your order. All orders are subject to product availability and a confirmation of purchase email. In the case of an inaccuracy on the website, we will try to contact you as quickly as possible to solve the issue, however, we reserve the right to cancel orders, update information or correct any inaccuracies or errors on the website where necessary. You agree to provide current, correct and complete account and other information when purchasing from our website.
